Agreement to Terms

These Terms of Service ("Terms") govern your use of skouter.app and related services ("Skouter" or the "Service"), operated by VideoYeti Media ("we," "us," or "our"). By creating an account or using Skouter, you agree to these Terms. If you do not agree, do not use the Service.

Beta Service

Skouter is currently in beta. This means features may change, data may be reset, and the service may experience interruptions. We provide the beta service as-is and make no guarantees about uptime, data preservation, or feature availability during the beta period. Your feedback during beta is valuable and helps us improve — you can reach us at info@videoyeti.com.

Your Account

You must provide accurate information when creating your account. You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. You must be at least 13 years old to use Skouter. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

Your Content

"Your Content" means photos, location descriptions, Q&A answers, profile information, and any other material you upload or submit to Skouter. You retain full ownership and copyright of Your Content.

By submitting content to Skouter, you grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute Your Content on the Service for the purpose of operating and promoting Skouter. This license continues until you delete Your Content or your account, at which point we will remove it within a reasonable timeframe (typically within 30 days, excluding cached copies and backups).

You represent and warrant that you own or have all necessary rights and permissions to submit Your Content, and that Your Content does not infringe or violate any third party's intellectual property rights, privacy rights, or other legal rights.

Photography and Location Responsibilities

This section is important. When you use Skouter to find, plan, or document shoot locations, you are solely responsible for:

Permissions and permits. Obtaining any required permits, permissions, or authorizations before photographing or filming at any location. This includes permits from property owners, local government agencies, parks departments, and any other relevant authorities. Location listings on Skouter may include permit information contributed by community members, but this information may be outdated, incomplete, or inaccurate. Always verify permit requirements directly with the property owner or relevant authority before your shoot.

Private property. Respecting private property boundaries. A location being listed on Skouter does not mean you have permission to access it. Many locations listed are public spaces, but some may include private property, restricted areas, or locations that require advance booking. It is your responsibility to confirm access rights before visiting.

People in your photos. If your photos include recognizable individuals, you are responsible for obtaining appropriate consent before uploading those photos to Skouter. Do not upload photos of people — especially children — without their knowledge and permission. Photos uploaded to location pages are publicly visible.

Sensitive locations. Exercise judgment when photographing near schools, government buildings, military installations, private residences, or other sensitive areas. Follow all posted signage and local regulations. Some locations may have specific restrictions on commercial photography or drone use.

Drone operations. If you use a drone, you are responsible for compliance with all applicable FAA regulations (in the US) or equivalent aviation authorities in your jurisdiction, including airspace restrictions, registration requirements, and Part 107 certification. Skouter may display drone zone information, but this is for reference only and may not reflect current restrictions. Always check current airspace authorizations before flying.

Location Information Disclaimer

Location data on Skouter — including descriptions, access notes, parking information, noise levels, permit details, and best-time recommendations — is contributed by community members and may not be accurate, complete, or current. Conditions at locations change: construction happens, access policies change, permit requirements are updated, trees are removed, and businesses close. Skouter does not independently verify location information. You should always confirm conditions, access, and requirements directly before planning a shoot. Skouter is not liable for any costs, damages, or inconvenience arising from inaccurate or outdated location information.

Prohibited Conduct

You agree not to: upload content you do not own or have rights to; upload photos containing identifiable individuals without their consent; submit false, misleading, or spam location data; harass, threaten, or abuse other users; use Skouter for any unlawful purpose; scrape, crawl, or systematically download content from Skouter; attempt to gain unauthorized access to any part of the Service; or use the platform to compile a competing location database.

Copyright and DMCA

We respect intellectual property rights. If you believe content on Skouter infringes your copyright, you may submit a takedown notice to info@videoyeti.com with the following information: a description of the copyrighted work you claim has been infringed; the URL or location on Skouter where the infringing material appears; your contact information; a statement that you have a good faith belief that the use is not authorized; and a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We will respond to valid DMCA notices promptly and may remove or disable access to the allegedly infringing content. Repeat infringers may have their accounts terminated.

Paid Subscriptions

Some features of Skouter require a paid subscription (Essential, Pro, Pro Team, or Space Owner tiers). Subscription fees, billing cycles, and included features are described on our pricing page. Subscriptions renew automatically unless cancelled. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis — contact info@videoyeti.com.

Limitation of Liability

To the maximum extent permitted by law, Skouter and VideoYeti Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. This includes but is not limited to damages arising from: reliance on location information provided by community members; inability to access a location; permit violations or trespassing; property damage or personal injury at a shoot location; or loss of data during the beta period.

Indemnification

You agree to indemnify and hold harmless VideoYeti Media, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the date at the top of this page and, where possible, by email. Continued use of Skouter after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Skouter shall be resolved in the courts located in Jefferson County, Kentucky.
