These Terms of Service (“Terms”) govern your use of Skouter (“the Platform”), operated by VideoYeti LLC (“we,” “us,” “our”), accessible at skouter.app. By creating an account or using the Platform, you agree to these Terms.

1. What Skouter Is

Skouter is a community-powered platform for finding photo and video locations, planning shoots with sun and shadow data, and connecting with local creatives. Users can browse locations, contribute photos, share production intel, plan shoots, and connect with other professionals.

2. Beta Status

Skouter is currently in beta. Features may change, be added, or be removed. Data may be affected by testing. Service availability is not guaranteed during this period. We will give reasonable notice before making significant changes that affect users, but we reserve the right to iterate quickly on product decisions during beta.

3. Accounts

You must be at least 16 years old to create an account. By signing up, you represent that you meet this requirement. You are responsible for maintaining the security of your account credentials. One person, one account — automated account creation is not permitted.

We may suspend or terminate accounts that violate these Terms, engage in spam or abuse, or are inactive for more than 12 months.

4. Your Content

“Your Content” means photos, text, ratings, tips, Field Notes, and other material you upload or post to Skouter. You retain ownership of your content.

By posting content to Skouter, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to display, reproduce, distribute, modify, and promote your content on the Platform and in marketing materials (such as social media posts featuring community photos). This license exists so the Platform can function — we need to display your photos on location pages, in search results, and in shared links.

Community Use: Photos you upload may be featured by other Skouter users in their Field Notes and blog posts. When this happens, your name and a link to your profile are displayed as credit. This is designed to give you visibility, not to take ownership of your work. You can restrict individual photos from community use at any time in your profile settings. Restricted photos will not appear in the community photo browser and will be removed from any Field Notes where they were previously used.

AI Analysis: Skouter may use artificial intelligence to analyze your photos for lighting conditions, composition, and scene characteristics. This helps other photographers learn from your work and improves location recommendations. AI analysis only runs on photos where you have opted in — you control this per photo at upload time, and can change it later in your settings. We do not use your photos to train AI models. Analysis results are displayed on the Platform alongside your photo with your name credited.

You can remove your content at any time by deleting it from the Platform. Once deleted, we will remove it from active display, though cached versions may persist briefly in CDNs and search engine caches.

Warranties: You represent and warrant that you have the right to share any content you upload, that the content does not infringe any third-party copyright, trademark, right of publicity, or privacy right, and that you have obtained all necessary consents from identifiable individuals appearing in your photos. Do not upload photos you didn't take, content that infringes copyright, or images of people without their consent (unless in a public setting where no reasonable expectation of privacy exists).

5. EXIF Data & GPS Information

When you upload photos, Skouter may extract EXIF metadata including GPS coordinates, camera settings, timestamps, and device information. This data is used to tag photos to locations, display camera settings, and improve the Platform's accuracy.

GPS coordinates extracted from photos are displayed on the Platform to show where photos were taken (“shot from” pins). If you do not want location data shared, strip EXIF data from your photos before uploading, or use the privacy controls in your settings.

6. Community Guidelines

Skouter is a professional community. You agree not to:

  • Post content that is illegal, harmful, threatening, abusive, or harassing
  • Upload photos of private property interiors without the owner's permission
  • Spam ratings, reviews, or location suggestions
  • Attempt to manipulate the points or ranking systems
  • Scrape or bulk-download data from the Platform
  • Use the Platform to stalk, surveil, or track individuals
  • Post misleading or false location information
  • Upload content that sexualizes or endangers minors

We may remove content and suspend accounts that violate these guidelines. Repeat or serious violations result in permanent removal.

7. Copyright & DMCA

Skouter respects intellectual property rights. If you believe content on the Platform infringes your copyright, send a DMCA takedown notice to info@videoyeti.com with the information required by 17 U.S.C. § 512(c)(3). Our full DMCA policy, including counter-notification procedures and repeat-infringer policy, is available at /dmca.

8. Space Owners

Venue and space owners can claim their location listing. Claiming gives you control over the description, hours, pricing, photos, and cover image. You cannot remove community-contributed photos, ratings, or tips — those belong to their respective authors. Space ownership features are free during beta.

9. Paid Features

Skouter is currently free to join and use. Every feature is unlocked for every account during beta. We may introduce paid features in the future; if we do, we will give reasonable advance notice, grandfather reasonable access where feasible, and only charge for clearly-defined optional features. Any future paid subscriptions will be billed through Stripe. Prices are disclosed at the point of sale, can be cancelled anytime, and do not auto-increase without notice.

10. Accuracy & Disclaimers

Sun data, shadow maps, golden hour times, and weather information (where shown) are calculated from astronomical algorithms and third-party APIs. While we strive for accuracy, this data is for planning purposes only. Actual conditions on location may differ.

Community-contributed information (ratings, tips, permit status, noise levels) is user-generated and not verified by Skouter. Always confirm critical details directly with venue owners or local authorities before a shoot.

Good Faith Operations: Skouter is a small, independently operated platform. We build and maintain this service in good faith with the resources available to us. Despite our best efforts, technical errors, bugs, and unintended behavior may occur. If a system error causes content to be displayed incorrectly, processed without proper consent flags, or otherwise behaves in an unintended way, we commit to investigating promptly, correcting the issue, and communicating transparently with affected users. Unintentional technical errors are not grounds for claims of willful misconduct.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

To the maximum extent permitted by law, VideoYeti LLC, its founders, employees, and contractors are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of data, loss of revenue, or damages resulting from technical errors, unauthorized access, or service interruptions.

Our total aggregate liability for any claims related to the Platform is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

You agree to indemnify and hold harmless VideoYeti LLC from any claims, damages, or expenses arising from your use of the Platform, your content, or your violation of these Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Any dispute not resolved informally will be resolved through binding arbitration in Jefferson County, Kentucky, under the rules of the American Arbitration Association. You and Skouter each waive the right to a jury trial and the right to participate in any class action.

13. Changes to These Terms

We may update these Terms. Material changes will be communicated via email or a notice on the Platform. Continued use after changes constitutes acceptance.
